What can I do about a bad contractor?

You expect your contractor to do the best job possible on your California home. Not all contractors are created equal, and in the event you’re unsatisfied with the finished product you want to rest assured that you take the proper steps. House Logic explains how you can deal with a bad contractor and protect yourself in the process.

Make sure a firing is legal

If you plan on firing the contractor, make sure you take the proper steps to defend any counterclaims. It’s best to document every mistake made leading up to firing, as well as properly documenting any breaches of contract. This will provide a firm basis for the firing and prevent you from being hit with your own breach of contract suit.

Consider small claims court

If the cost for repairs isn’t too extreme, you’re best served by small claims court. In this case, you and the contractor will represent yourselves in front of a judge, who will make a determination on what should be done to remedy the issue. There are limitations to how much can be litigated within small claims court. In most states, the amount is between $3,000 and $7,500, although it can vary quite a bit.

Ask an attorney for help

An attorney’s assistance is recommended when having a hearing. For instance, an attorney will increase your chance of reward for wrongdoing, whether that entails the contractor returning the cost of improvements or the receipt of money from a recovery fund. An attorney will also have a better grasp of the laws in your state, which can have an impact on whether your claim is successful.
